Former Vilas Assistant DA suspended

Former Vilas County Assistant District Attorney Jim Fitzgerald has had his license to practice law suspended for 90 days.

On July 27, the state supreme court's office of lawyer regulation filed an order suspending Fitzgerald for 90 days for failing to pay his bar association dues, failing to continue his legal education as required and practicing law without a valid license.

Fitzgerald resigned his position with Vilas County two years after it was discovered the Wisconsin State Bar Association had suspended him.

In a statement announcing the resignation, Vilas County District Attorney Al Moustakis said Fitzgerald failed to inform him the Wisconsin State Bar Association had suspended him for failing to pay dues in the years 2003 and 2004.

According to the office of lawyer regulation, Fitzgerald continued to practice law after he was suspended for not paying association dues and failing to attend required continuing legal education courses.

Between November 8, 2003 and June 6, 2005, Fitzgerald appeared as the prosecutor of record in approximately 85 felony cases, 200 misdemeanor cases, 121 criminal traffic cases and 180 civil forfeiture cases, without having a valid license to practice law.

Vilas County sent a notice to all defendants whose cases were handled by Fitzgerald while his license to practice law was suspended.

Fitzgerald was hired as assistant district attorney in Vilas County in October of 2003. David Breedlove now holds the position.
